Restaurants in all of Mississippi have a duty to provide a safe and hazard-free environment for their customers. When that duty is breached and a customer suffers an injury, the establishment is then at risk of being sued for damages. A restaurant chain with more than 100 locations nationwide was recently sued in 2019 after Eddie Tucker of Hinds County slipped and fell inside one of the restaurant locations in 2018.
The Clarion Ledger reported that the incident occurred on May 25, 2018, during Eddie Tucker and his wife’s visit to Newk’s Eatery in Jackson, MS. Court documents claim Tucker went to refill his drink at the self-serve beverage area and as he started to walk back to his booth, he slipped on the wet floor and fell. Tucker says he sustained “significant bodily injuries” as well as “physical and mental pain and suffering.”
The couple decided to file suit not only to recognize Newk’s Eatery for creating a “dangerous condition,” but also to obtain compensation for the injuries and losses suffered. The lawsuit requests that the couple be awarded $57,950 for the medical expenses Tucker incurred along with compensation to cover lost wages, attorneys’ fees, additional damages, and more.
